Government proposes legal updates
The Union government is working to amend copyright laws to address the complex demands of artificial intelligence. A new working paper from the Department for Promotion of Industry and Internal Trade outlines these changes which are expected to be finalized within the next three years.
New licensing model suggested
The proposal suggests a blanket licensing framework for internet data usage. Under this system websites that are scraped by large language models would receive royalty payouts which would be collected and distributed through a central copyright society to ensuring fair compensation.
Collection society for royalties
This proposed body is known as the Copyright Royalties Collective for AI Training or CRCAT. Officials stated that AI companies would only be required to seek these payments and pay royalties once their models are fully commercialized rather than during the training phase.
Tech firms voice concerns
Industry body Nasscom dissented from the report on behalf of tech giants like Google and Meta. They argue that publishers should simply have the right to opt out of data sharing rather than enforcing a mandatory blanket licensing model on developers.
Dispute over legal burden
Big Tech warns this proposal reverses established jurisprudence regarding infringement. It places the burden on developers to prove they did not use specific content which is technically difficult to verify given the probabilistic and non deterministic nature of generative AI tools.
